Commercial dispute resolution in Pakistan is governed by the Contract Act 1872 (for contract disputes), Companies Act 2017 (for corporate disputes), Partnership Act 1932 (for partnership disputes), Arbitration Act 1940 (for arbitration), and CPC 1908 (for civil procedure). The Qanun-e-Shahadat 1984 governs evidence in commercial matters. The Limitation Act 1908 provides time limits (3 years for contract suits).
File a civil suit in the court of Civil Judge or District Court having jurisdiction over the matter. The suit must include the contract terms, nature of breach, and relief sought (damages, specific performance, or injunction). The limitation period is 3 years from the date of breach under Article 113 of the Limitation Act 1908. The defendant must be served with notice under Order 5 CPC.
Arbitration is governed by the Arbitration Act 1940. The dispute must be referred to an arbitrator named in the contract or appointed by the court under Section 8. The arbitrator hears both parties and issues an award. The award can be made a decree of the court under Section 17 and is enforceable as a court judgment.
