File under Section 8 of the Specific Relief Act, 1877. You must prove better legal title than the current occupant. The suit is filed in the civil court with jurisdiction over the property's location. Relief for declaration of title is automatically included. Key documents required include sale deed, inheritance certificate, revenue records (fard), and tax receipts. The limitation period is 12 years from the date of dispossession.
Section 8 requires proving ownership title. Section 9 is a summary remedy for forcible dispossession within 6 months — no title proof needed, only prior lawful possession. Section 9 is faster but limited to 6 months from dispossession. After 6 months, you must file under Section 8 with full title evidence.
Under Section 42 of the Specific Relief Act, 1877. It is filed when someone denies your legal right or title to property. The court declares your rights without granting possession. If you also need possession, you must ask for it as "further relief." A suit for declaration alone is not maintainable if possession is also required.
Not maintainable under Section 42. A negative declaration asks the court to declare the defendant has no rights. Pakistani law requires the plaintiff to claim their own legal right, not just deny another's. You cannot simply ask the court to declare your neighbor has no right to a pathway. You must claim your own right to the property in question.
Shamilat is common village land. Rights include grazing, pathways, and community use. Individual ownership is not recognized. Disputes are governed by revenue laws and settled by civil courts or revenue officers. No individual can sell or transfer Shamilat land. Encroachment is illegal and can be challenged through the revenue department or civil suit.
File in civil court. Co-sharers can request physical division or sale of property. The court appoints a commissioner to divide shares. If physical division is impractical, the property is sold and proceeds distributed. All legal heirs must be made parties. The suit is governed by the Partition Act, 1893. Mediation is encouraged before trial.
Possession suit: you are out and want to get back in. Injunction suit: you are in possession but fear disturbance. If title is disputed, an injunction without declaration is not allowed. Injunction is governed by Order 39, CPC. Permanent injunction requires proving a legal right to the property.

She can also file a civil suit for recovery. The wife has priority over other creditors. Dower is a debt and can be claimed from the husband's estate after his death as well.

Under Section 11, CPC. It bars re-litigation of the same issue between the same parties if a competent court has already decided it. It ensures finality in legal disputes. For res judicata to apply, the matter must have been "directly and substantially" in issue in the earlier suit. It applies even if the earlier decision was erroneous.
