Child custody law in Pakistan is governed by the Guardians and Wards Act 1890, with the welfare of the minor as the paramount consideration [citation:1]. The law distinguishes between custody (Hizanat) and guardianship (Wilayah) [citation:5]. Mothers have preferential custody rights for children of tender years, known as Hizanat [citation:10]. The child's welfare, health, education, and religious upbringing are primary factors in custody decisions [citation:1].
File a petition in the Family Court or before the Guardianship Judge in Peshawar under the Guardians and Wards Act 1890 [citation:9]. The court considers the welfare of the child, age, religion, and capacity of the guardian as primary factors.
